Supplemental Terms of Use

These Supplemental Terms of Use govern LumaNest-specific accounts, optional Cloud Sync, optional improvement program participation, AI-assisted features, subscriptions, this website, and related services.

Service provider: H S, an individual sole proprietor operating LumaNest in Washington State, United States.

1. Apple Standard EULA and these Supplemental Terms

The license to download, install, and use the LumaNest app obtained through the App Store is governed by Apple’s Standard Licensed Application End User License Agreement. LumaNest currently does not provide a Custom EULA.

These Supplemental Terms address LumaNest-specific services. They do not replace or rewrite Apple’s Standard EULA. If these Supplemental Terms conflict with the Standard EULA or non-waivable law, the Standard EULA or non-waivable law controls to the extent of the conflict.

By creating an account, enabling Cloud Sync, purchasing a subscription, joining an optional improvement program, using an AI-assisted feature, using the website, or otherwise using a LumaNest-specific service, you agree to these Supplemental Terms and the Privacy Policy. If you do not agree, do not use the applicable service.

2. Eligibility and responsibility for child information

LumaNest is intended for adults who are parents, guardians, or caregivers. A child may not create or control a LumaNest account.

You must be at least 18 years old, or the age of majority where you live if that age is higher, to create a LumaNest account, purchase a subscription, or agree to these Supplemental Terms.

Core logging and on-device sleep prediction are designed to work fully offline without an account. You may log Sleep, Nursing, Bottle, Solids, and Diaper activities; view trends; use the in-app sleep and nursing timers; and import/export Activity CSV on device.

Home Screen and Lock Screen widgets, Live Activities, and Shortcuts/Siri actions are system entry points unlocked by LumaNest Plus (section 3.2). You may still add them without a subscription; they then show a locked state that links to the membership screen instead of your baby's data.

You represent that you are authorized to enter, synchronize, analyze, and manage information about each child whose profile or records you create. You are responsible for the accuracy of information you enter and for deciding whether, when, and how to rely on a record, prediction, recommendation, or AI-generated response.

3. The service

3.1 Local-first features

Core logging, history, export, and personalized sleep prediction are designed to work locally without an account. Local use may continue while the device is offline, subject to operating-system limitations and the information available on that device.

Core recording, planning, and reports in the main app are free on a single device. LumaNest Plus unlocks Cloud Sync (section 3.2) and the Home Screen, Lock Screen, and other system entry points described in section 2. A subscription does not force upload and does not remove local-first use of logging, prediction, planning, or reports on a single device.

3.2 Accounts and Cloud Sync

Cloud Sync is an optional multi-device synchronization service available only where shown in the app. It requires a supported account, a separate explicit choice to enable Cloud Sync, and any entitlement shown by the app.

Signing in, subscribing, or restoring a purchase does not by itself upload existing local records. The app presents a separate confirmation before existing local data is uploaded. Turning Cloud Sync off on one device stops synchronization on that device but does not delete the account or the existing cloud copy.

Cloud Sync is a convenience service, not a guaranteed archival backup. Keep an independent export of records that are important to you.

3.3 Personalized prediction

Relevant records available on a device, including records received through Cloud Sync, may be used on that device to train, update, or calibrate a separate personalized prediction model for the selected baby. Prediction methods, inputs, thresholds, and presentation may change as the product is improved.

Predictions are estimates. They may be early, late, unavailable, incomplete, or unsuitable for a particular situation. LumaNest does not promise a particular accuracy level or any particular sleep, feeding, health, developmental, or caregiving result.

3.4 Optional improvement program

Not part of the current release. This section describes a planned feature. No improvement data exists or is processed today.

Cloud Sync may make an optional LumaNest improvement program available. Enabling Cloud Sync alone does not enroll you in the improvement program. Participation requires a separate, explicit choice presented in the app.

If you join, LumaNest may transform selected cloud-synchronized information into de-identified or aggregated improvement data and use it to evaluate and improve LumaNest’s own prediction methods, algorithms, and features, and to produce internal product statistics. LumaNest does not use improvement data to conduct scientific or human-subject research, and does not publish or present findings drawn from it.

Improvement data may include age or corrected-age ranges, sleep and wake information, feeding and diaper information when recorded, derived patterns, and limited technical context. LumaNest will remove direct identifiers such as names, email addresses, account identifiers, and device identifiers from improvement datasets and will use reasonable measures designed to prevent re-identification. Service providers that assist with this analysis must be bound by confidentiality, purpose limitations, and a prohibition on attempting to re-identify anyone.

You may withdraw from future improvement use through the control provided in the app or by submitting a Privacy Request. Withdrawal stops new improvement use associated with your account after it is processed. It may not remove information that was already irreversibly de-identified, combined into aggregate statistics, or incorporated into completed internal analyses.

3.5 Optional AI Assistant

Not part of the current release. This section describes a planned feature. LumaNest does not send any information to an external AI provider today.

When offered, the AI Assistant is optional and requires a clear permission before personal information is sent to an external AI service provider. It is activated by a user request and does not automatically analyze the entire Cloud Sync account.

To generate a response, LumaNest may send a limited prompt and context to a commercial language-model provider, which may include OpenAI or Anthropic. Depending on what the user asks and permits, that context may include the user’s question, a baby’s first name or nickname, age or corrected age, sleep, feeding, and diaper information, and other selected care information.

LumaNest may use de-identified or aggregated AI Assistant interactions to improve its prompts, retrieval, safety systems, personalization, and algorithms. LumaNest will not opt customer API data into an external provider’s general model training without a separate explicit permission.

AI-generated content may be inaccurate, incomplete, outdated, biased, unsafe, or inappropriate for a particular child or situation. It must not be treated as medical advice, diagnosis, treatment, emergency guidance, or a substitute for professional care.

4. LumaNest Plus and Apple subscriptions

Where offered, LumaNest Plus provides the paid features identified on the Apple purchase screen. The purchase screen displays the current product, billing period, price, currency, taxes, eligibility, and any trial or introductory offer. That Apple-displayed information controls the purchase.

Apple bills subscriptions to your Apple account. Subscriptions automatically renew unless cancelled through Apple before the applicable renewal date. A trial or introductory offer converts to the paid subscription shown by Apple unless cancelled before it ends. Cancellation normally stops a future renewal while access continues through the paid period, subject to Apple’s rules. Refund requests are handled by Apple unless applicable law requires otherwise.

Use Restore Purchases in the app to restore an eligible Apple purchase. Purchase, renewal, restoration, billing recovery, or cancellation status may take a short time to update.

Deleting a LumaNest account, deleting the app, signing out, or turning off Cloud Sync does not cancel an Apple subscription. Manage the subscription separately through Apple.

5. Accounts and security

You are responsible for safeguarding your device, email account, authentication credentials, and Apple or Google account. Do not share passwords, authentication tokens, or account access with a person who is not authorized to manage the child’s information.

Provide accurate account information. Email hexacanvaslabs+support@gmail.com with the subject Security Report if you believe an account or the service has been compromised. LumaNest may require recent authentication before sensitive actions such as account deletion, improvement program enrollment, or changing AI-related permissions.

One LumaNest account currently represents one account data space. Anyone who can validly sign in to that account and enable Cloud Sync may be able to view or change synchronized information.

6. Important health, safety, and AI disclaimer

LumaNest is a recordkeeping and caregiving-reference tool. Sleep predictions, wake windows, expected durations, schedules, reminders, trends, and AI-generated content are provided for general informational and educational purposes only.

LumaNest is not a medical provider, medical device, baby monitor, apnea monitor, emergency service, or substitute for direct supervision or professional advice. It does not provide diagnosis or treatment and does not guarantee that a baby will sleep, wake, feed, breathe, grow, remain safe, or develop in a particular way.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU USE AND RELY ON LUMANEST, ITS PREDICTIONS, AND AI-GENERATED CONTENT AT YOUR SOLE RISK. YOU ARE SOLELY RESPONSIBLE FOR DECISIONS OR ACTIONS TAKEN IN RELIANCE ON THAT INFORMATION.

Use your own judgment, follow guidance from qualified healthcare professionals and applicable safety authorities, and contact local emergency services when appropriate. Do not delay, disregard, start, or stop professional care because of information displayed by LumaNest.

7. Your records and permissions

You retain ownership of the profiles, records, custom food entries, notes, and files you enter or upload.

You give LumaNest limited, non-exclusive permission to host, copy, transmit, synchronize, format, display, back up, and otherwise process that content only as reasonably necessary to provide the features you choose, operate Cloud Sync, provide personalized prediction, process an AI Assistant request, complete a support or privacy request, protect the service, and comply with law.

If you separately join the optional improvement program, you also permit LumaNest to create and use de-identified or aggregated improvement data as described above and in the Privacy Policy. This does not transfer ownership of your identifiable care records to LumaNest.

These permissions end when the relevant identifiable content is deleted from active LumaNest systems, subject to limited retention described in the Privacy Policy. Irreversibly de-identified or aggregated information that is no longer personal information may be retained and used for internal statistics and product improvement.

LumaNest does not use identifiable baby records or AI Assistant content for targeted advertising. You are responsible for ensuring that content you provide is lawful and that you have authority to provide it.

8. Acceptable use

You must not access another account without authorization; disrupt, overload, scrape, probe, or interfere with the service; bypass subscription or security controls; upload malicious or unlawful content; infringe another person’s rights; submit false security reports; expose user data; or misrepresent affiliation with LumaNest or a service provider.

Restrictions concerning copying, redistribution, reverse engineering, modification, and other treatment of the licensed app are governed by Apple’s Standard EULA rather than repeated here.

LumaNest may investigate suspected misuse and may limit or suspend account-backed services where reasonably necessary to protect users, the service, or legal rights.

9. Availability, changes, and backups

LumaNest depends on devices, networks, operating systems, app stores, authentication providers, AI providers, analysis service providers, and hosting systems that it does not fully control. Features may be delayed, interrupted, changed, limited by region or device, or discontinued.

Synchronization may be delayed, and conflicts may be resolved under the synchronization behavior in the current app version. You are responsible for reviewing important records and keeping independent exports when loss would be significant.

LumaNest may update the app, prediction system, AI Assistant, improvement program, supported operating-system version, data format, subscription offering, or website. A new purpose requiring consent will not begin merely because you continue using the app; LumaNest will obtain a new choice where applicable law or Apple policy requires it.

10. Third-party services, cookies, and advertising technologies

LumaNest may rely on Apple, Firebase Authentication, Google Sign-In, Cloudflare, RevenueCat, commercial AI providers such as OpenAI or Anthropic, analysis service providers, and a video provider that loads only after you choose to play a video. Their terms, availability, and privacy practices apply to the parts of the service they provide.

The initial website release uses cookie-free aggregate Cloudflare Web Analytics and does not enable advertising cookies or cross-site advertising. The rest of this paragraph describes planned technologies. None of them are active today. LumaNest may later use cookies, pixels, advertising networks, campaign measurement, or cross-site advertising technologies on the website or in marketing campaigns. Before activating such technologies, LumaNest will provide any notice, consent, preference control, and opt-out required by applicable law.

Baby care records, improvement-source records, and AI Assistant content will not be used to target advertising. If the iOS app later engages in tracking across apps or websites owned by other companies, it will request authorization through Apple’s App Tracking Transparency framework before tracking.

Personal information is handled as described in the Privacy Policy. Nothing in these Supplemental Terms expands the data uses described there.

11. Intellectual property and feedback

The license to install and use the app is granted under Apple’s Standard EULA. These Supplemental Terms do not replace or expand that app license.

LumaNest’s name, branding, app software, website, designs, text, graphics, product materials, and other materials are owned by the provider or licensors and are protected by applicable law. References to third-party products or trademarks do not imply partnership or endorsement.

LumaNest may use general feedback to improve the product without an obligation to compensate you. Feedback is not permission to use identifiable baby records outside the Privacy Policy.

12. Account deletion, suspension, and termination

You may stop using LumaNest at any time. You may delete individual records, baby profiles, local data, or the entire account through the applicable in-app controls.

To delete the account and associated cloud data, use Profile → Account → Delete Account and complete the required recent authentication and confirmation. The Account deletion page explains the effect, timing, local-data choice, improvement-data boundary, AI-provider records, and subscription warning.

LumaNest may suspend or terminate account-backed services for material violation of these Supplemental Terms, fraud, abuse, security risk, legal requirement, or conduct that threatens another user or the service. Immediate action may be necessary for security or legal reasons.

13. No warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMANEST-SPECIFIC SERVICES, CLOUD SYNC, IMPROVEMENT PROGRAM MATERIALS, AI-GENERATED CONTENT, THE WEBSITE, AND ALL RELATED INFORMATION ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS, WITHOUT WARRANTIES OF ANY KIND.

LumaNest disclaims all express, implied, and statutory warranties to the extent legally permitted, including merchantability, fitness for a particular purpose, accuracy, reliability, availability, data preservation, non-infringement, quiet enjoyment, and any warranty arising from course of dealing or usage of trade. LumaNest does not warrant uninterrupted service, error-free synchronization, complete preservation of records, accurate predictions, correct AI responses, or any particular caregiving outcome.

Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you. Nothing excludes a warranty or consumer remedy that applicable law does not permit LumaNest to exclude.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMANEST AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA; BUSINESS INTERRUPTION; OR CAREGIVING, HEALTH, SAFETY, OR AI-RELIANCE OUTCOMES ARISING OUT OF OR RELATING TO THE LUMANEST-SPECIFIC SERVICES.

For claims governed by these Supplemental Terms, LumaNest’s total cumulative liability will not exceed the greater of: (a) the amount you paid for LumaNest-specific services during the 12 months immediately preceding the event giving rise to the claim; or (b) US$100. More than one claim does not increase this limit.

This Supplemental Terms cap applies to LumaNest-specific accounts, Cloud Sync, AI-assisted features, improvement program participation, subscriptions, website use, and support. Apple’s Standard EULA governs liability associated with the licensed app to the extent its provisions apply.

The exclusions and cap do not apply to the extent prohibited by law, including liability that cannot be limited for fraud, willful misconduct, gross negligence where non-waivable, personal injury, or mandatory consumer rights.

15. Governing law, disputes, and severability

These Supplemental Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. This choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the place where you habitually reside.

Any dispute arising out of or relating to these Supplemental Terms or the LumaNest-specific services will be brought exclusively in the state or federal courts located in Washington State, and you and LumaNest consent to the personal jurisdiction of those courts. Either of you may instead bring an individual claim in a small-claims court that has jurisdiction.

To the maximum extent permitted by applicable law, a dispute must be brought in an individual capacity, and not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding. Where applicable law does not permit this limitation, it does not apply to you.

If a provision of these Supplemental Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. A delay or failure to enforce a provision is not a waiver of it.

16. Changes and contact

LumaNest may update these Supplemental Terms as the service, law, or commercial offering changes. The version and dates at the top identify the current text. Reasonable notice of a material change may be provided through the app, website, or account email when available. Where applicable law requires a new consent, continued use alone will not replace that consent.
